Documents to be submitted by operational Creditor with
application for insolvency resolution process of corporate Debtor
:-Section 9(3) of code specifies documents to be submitted
by operational creditor with application for insolvency resolution process of
Corporate Debtor .Now some of the provision has been modified and made
practical.
Along With Application following document is to be furnish:-
Ø
A copy of the invoice demanding payment or
demand notice delivered by the operational creditor to corporate debtor.
Ø
An affidavit to that effect that there is no
notice given by the corporate debtor relating to dispute
Ø
A copy of certificate from the financial institution
maintaining accounts of the operational creditor confirming that there is no
payment of unpaid operational debt by CD, if
available
Ø
A copy of
any record with information utility confirming that there is no payment of
unpaid operational debt by corporate debtor, if available; and
Ø
Any other
proof confirming that there is no payment.
